Terms of Service
Please read these Terms of Service carefully before utilizing the ZYVV portal, engaging our consulting services, or deploying the Flux Web Security Suite desktop platform.
The Flux Web Security Suite incorporates powerful security analysis capabilities, including HTTP interception, automated parameter fuzzing, and vulnerability discovery pipelines. You agree to utilize these tools strictly against networks, hosts, and applications for which you have explicit, written authorization (such as an active Bug Bounty program scope or signed penetration testing engagement). Unauthorized testing of external infrastructure is strictly unlawful and violates these Terms.
01. Acceptance of Agreement
By accessing zyvv.dev, creating an account, paying for a subscription, or downloading and running the Flux desktop software, you (“User”, “Organization”) agree to be legally bound by these Terms of Service (“Terms”) in full. If you are entering into this agreement on behalf of a company or legal entity, you represent that you possess the authority to bind such entity.
02. Software License & Cryptographic Node Locking
Subject to these Terms and your active subscription tier, ZYVV grants you a revocable, non-exclusive, non-transferable license to install and execute the Flux Web Security Suite desktop software:
- Flux Community Tier: Free lifetime software license for individual researchers, educational assessments, and personal security environments. Zero license key registration is required.
- Flux Professional Tier ($5/mo or $50/yr): Single-seat offensive security workbench licensed to one human operator. Professional licenses are cryptographically signed using asymmetric Ed25519 digital signatures and bound to the operator's machine authorization hash (HWID). Operators may re-bind or rotate their designated machine at any time through their ZYVV customer dashboard.
- Flux Enterprise Tier ($20/mo or $200/yr): Multi-seat team license pool (up to 5 machines) with shared team cloud workspaces, Neon DB sync, white-label executive PDF report generation, custom AST detection rule engines, distributed fuzzing, and priority SLA.
You may not decompile, reverse-engineer, modify, redistribute, or circumvent the offline cryptographic license validation mechanisms of binary distributions.
03. Acceptable Use & Offensive Security Warranty
You warrant, represent, and certify to ZYVV Inc. that:
ZYVV reserves the immediate right to terminate accounts, revoke active cryptographic licenses, and cooperate with law enforcement authorities in the event of documented malicious or unauthorized activity.
04. Subscriptions, Billing & Enterprise Invoicing
Paid software subscriptions for Flux Professional and Enterprise are billed on a recurring monthly or annual basis.
- Payment Processing: Online subscription payments are processed securely via PayPal. Customers may pay using their PayPal account balance or directly via Debit / Credit Card (Visa, Mastercard, Amex) through PayPal Guest Checkout.
- Enterprise Invoicing: Annual enterprise software fleet contracts and bespoke consulting engagements may be settled via direct corporate invoice (ACH / Wire transfer) pursuant to a signed Master Services Agreement (MSA).
- Automatic Renewal: Self-serve software subscriptions renew automatically at the end of each billing cycle unless cancelled prior to the renewal date.
- Cancellation: You may cancel your subscription at any time directly through your Customer Dashboard. Upon cancellation, your license remains valid and active until the conclusion of your pre-paid billing cycle.
05. Enterprise Consulting Services, SOW & 30-Day Retest Guarantee
Bespoke infrastructure modernization, zero-trust IAM architecture, web application penetration testing, and cybersecurity advisory engagements are executed under individual Statements of Work (SOW), bilateral Non-Disclosure Agreements (NDA), and enterprise Master Services Agreements (MSA).
Every advisory engagement is protected by strict mutual non-disclosure covenants, zero-data retention commitments, and full intellectual property assignment of all custom deliverables.
Penetration testing and code review clients benefit from complimentary re-testing and verification of all remediated vulnerabilities within 30 calendar days of final report delivery.
All assessment staging tokens, intercepted HTTP flows, and raw engagement workpapers are permanently expunged from our secure systems within 30 calendar days of project completion. In the event of any conflict between these general web Terms and a signed Master Services Agreement (MSA) or SOW, the signed bilateral agreement shall supersede and prevail.
06. Intellectual Property & Zero AI Training Warranty
All proprietary algorithms, AST JavaScript parser engines, software codebases, trademarks, and documentation are the exclusive intellectual property of ZYVV Inc. Conversely, all security findings, vulnerability dossiers, assessment notes, and custom wordlists generated by your local use of the Flux desktop application belong 100% to you and your organization.
Zero AI Training Warranty: ZYVV guarantees that customer source code, architecture schematics, and assessment workpapers are never ingested into, processed by, or used to train public or commercial third-party artificial intelligence models.
07. Disclaimers & Limitation of Liability
The Flux desktop suite and all ZYVV web services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. Security assessments and automated workbench tools represent point-in-time assessments and do not guarantee the identification of 100% of all software vulnerabilities, zero-days, or architectural defects.
To the maximum extent permitted by applicable law, in no event shall ZYVV Inc., its directors, employees, or partners be liable for any indirect, punitive, incidental, special, or consequential damages, or any loss of profits, revenue, data, or goodwill. In all events, our total cumulative liability shall not exceed the amount paid by you to ZYVV in the twelve (12) months preceding the claim.
08. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with international commercial law and the applicable laws of the jurisdiction in which ZYVV Inc. operates, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall first be resolved through good-faith informal negotiation, followed if necessary by binding commercial arbitration.
